Personal data processing policy

  1. General provisions, goals and objectives

1.1. This Policy was developed in accordance with the Federal Law of the Russian Federation dated July 27, 2006 No. 152-FZ “On Personal Data” (hereinafter referred to as PD) and other acts of the Russian Federation and determines the procedure for processing PD and measures to ensure the security of PD IP Nikitina Z.S. (hereinafter referred to as the Operator).

The Operator sets the most important goal and condition for carrying out its activities to respect the rights and freedoms of humans and citizens when processing their personal data, including the protection of rights to privacy, personal and family secrets.

This Operator Policy regarding the processing of personal data (hereinafter referred to as the Policy) applies to all information that the Operator can receive about visitors of the website http://lordore.com.

1.2. The goals of the Policy are:

- determination of the order of PD processing;

- ensuring compliance of the procedure for processing PD by the Operator in accordance with the legislation of the Russian Federation in the field of PD;

-  ensuring the protection of personal data.

1.3. The objectives of the Policy are:

- determination of principles for processing PD;

- determination of the conditions for processing personal data, methods of protecting personal data;

- determination of the rights of PD subjects, the rights and obligations of the Operator when processing PD.

1.4. This Policy has been developed taking into account the requirements of the following regulations:

- Constitution of the Russian Federation;

- Federal Law of the Russian Federation dated July 27, 2006 No. 149-FZ “On information, information technologies and information protection”;

- Federal Law of the Russian Federation dated July 27, 2006 No. 152-FZ “On Personal Data”;

- Decree of the Government of the Russian Federation dated November 1, 2012 No. 1119 “On approval of requirements for the protection of personal data during their processing in personal data information systems”;

- Decree of the Government of the Russian Federation dated September 15, 2008 No. 687 “On approval of the regulations on the specifics of processing personal data carried out without the use of automation tools”;

- Order of the FSTEC of Russia dated February 18, 2013 No. 21 “On approval of the composition and content of organizational and technical measures to ensure the security of personal data during their processing in personal data information systems”;

- Order of the FSTEC of Russia dated May 14, 2020 No. 68 “On amendments to the composition and content of organizational and technical measures to ensure the security of personal data during their processing in personal data information systems, approved by order of the Federal Service for Technical and Export Control dated February 18, 2013 No. 21";

- other acts applicable on the territory of the Russian Federation.

  1. Terms and definitions used in the Policy

Personal data (PD) – any information relating to a directly or indirectly identified or identifiable individual (PD subject).

PD subject is an individual (client/buyer/user, online store visitor) who has personal data directly or indirectly identifying him. In this document, this is an individual who intends to order, purchase goods and subsequently use the goods exclusively for personal, family, household and other needs not related to business activities.

PD processing is any action (operation) or set of actions (operations) performed using automation tools or without using such tools with PD, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of PD.

Automated PD processing – PD processing using computer technology.

Non-automated processing of PD – processing of PD with the direct participation of a person contained in the PD information system or extracted from such a system.

Cross-border transfer of personal data – transfer of personal data to the territory of a foreign state to an authority of a foreign state, a foreign individual or a foreign legal entity.

Confidentiality of PD is a mandatory requirement for the Operator or other official working with the User’s data to keep the information received secret without revealing it to outsiders, unless the Buyer who provided the personal data has expressed his consent, and there is no legal basis for disclosure.

Online store website – https://lordore.com/ (hereinafter referred to as the Website).

Site User/ Buyer - a person who has visited the Site of the online store, as well as using its programs and products.

Cookies are a short piece of data sent by a web browser or web client to a web server in an HTTP request whenever the Buyer tries to open an online store page. The fragment is stored on the Buyer 's computer.

IP address is a unique network address of a node in a computer network built using the TCP/IP protocol.

  1. Data request

The following data may be requested by the Operator and provided at the discretion of the Buyer:

- Last name, first name, patronymic (if available), date of birth, gender;

- Residence address or delivery address of the purchased goods;

- Contact information (telephone, email address);

- Details of the main identification document;

- Financial information, including credit or debit card number (last four digits of card number only), or other payment information;

- History of the Buyer’s acquisition of L’ORDORÉ goods and related services;

- History of calls to the Operator and interaction with the Operator;

- Interests and preferences of the Buyer in the field of fashion, jewellery, style, etc.;

- Other data at the discretion of the Buyer and the discretion of the Operator.

The Site also collects and processes anonymized data about visitors (including “cookie” files using Internet statistics services (Google Analytics, Yandex Metrica, etc.).

The above data is united under the general concept of Personal Data.

  1. Purposes of processing Personal Data

4.1. The purpose of processing the Buyer’s PD is to inform the User and clarify the details of the order. By providing his PD, the Buyer agrees to receive advertising information from the Operator, which can be provided by sending emails, text messages and in other ways that do not contradict the legislation of the Russian Federation.

4.2. The Buyer can always refuse to receive advertising information by notifying the Operator by phone +7 (960) 273 82 11 / email at contact@lordore.com/ via the Site.

4.3. Anonymized data of Buyers, collected using Internet statistics services, serves to collect information about the actions of Buyers on the Site, improve the quality of the Site and its content.

  1. Legal grounds for processing Personal Data

5.1. The Operator processes the Buyer’s PD only if it is filled out or sent by the Buyer independently through the Site. By sending his PD to the Operator, the Buyer expresses his consent to this Policy.

5.2. The Operator processes anonymized data about the Buyer if this is allowed in the Buyer’s browser settings (saving cookies and using JavaScript technology are enabled).

  1. Cases when the Operator has the right to disclose provided Personal Data to third parties

6.1. The Operator may disclose PD to employees and trusted partners of the Operator, who will process it on behalf of the Operator solely for the purposes stated in this Policy.

6.2. PD may be transferred to third parties, which include courier services, postal organizations, and telecommunication operators. This is done in order for the Buyer’s order left on the Site to be delivered to the address. The Buyer’s consent to such transfer is provided for by the provisions of the Site Policy.

6.3. The Operator makes every effort to ensure the protection of the Buyer’s PD when providing it to third parties and guarantees that processes are in place to protect it. All third parties processing personal data on behalf of the Operator guarantee compliance with all norms and standards applicable in the Russian Federation.

6.4. Personal data may be transferred to authorized government bodies of the Russian Federation if this is done on legal grounds and in the manner prescribed by Russian legislation.

6.5. In case of inaccuracies in the PD, the Buyer can update them independently by sending a notification to the Operator to the Operator's email address contact@lordore.com.

6.6. The period for processing PD is unlimited. The Buyer may at any time withdraw his consent to the processing of PD by sending a notification to the Operator by email to contact@lordore.com.

6.7. Before the start of cross-border transfer of PD, the Operator is obliged to make sure that the foreign state into whose territory it is intended to transfer PD, ensures reliable protection of the rights of the PD subject. Cross-border transfer of PD in the territories of states that do not meet the above requirements can only be carried out if there is written consent of the PD subject to the cross-border transfer of his PD and/or execution of an agreement to which the PD subject is a party.

7. General conditions

7.1. The Operator has the right to periodically update this Policy. The effective date of the new version of the Policy is the date indicated on the first page of the document. If the Buyer continues to interact in any way with the Operator, in particular (not limited to) through the Site, then the Buyer agrees with the current version of the Policy.

7.2. The Buyer has the right to receive any clarification on issues of interest regarding the processing of his PD by contacting the Operator by sending a letter to the Operator's email address contact@lordore.com.

7.3. The use of materials and services of the Site is governed by the current legislation of the Russian Federation.

7.4. This Policy is a public offer. By accessing the materials of the Site, the Buyer is considered to have acceded to this Policy (having accepted the terms of this Policy).

7.5. The Operator has the right to unilaterally change the terms of this Policy at any time. Such changes come into force from the moment the new version of the Policy is posted on the website. If the User disagrees with the changes made, he is obliged to refuse access to the Site and stop using the materials and services of the Site.

  1. Buyer Obligations

8.1. The Buyer agrees not to take actions that may be considered as violating Russian legislation or international law, including in the field of intellectual property, copyright and/or related rights, as well as any actions that lead or may lead to disruption of the normal operation of the Site and services Site.

8.2. The use of Site materials without the consent of the copyright holders is not permitted (Article 1270 of the Civil Code of the Russian Federation). For the lawful use of Site materials, it is necessary to conclude license agreements (obtain licenses) from the Copyright Holders.

8.3. When quoting materials from the Site, including protected copyright works, a link to the Site is required (subclause 1 of clause 1 of Article 1274 of the Civil Code of the Russian Federation).

8.4. Comments and other entries by the Buyer on the Site must not conflict with the requirements of the legislation of the Russian Federation and generally accepted standards of morality and morality.

8.5. The Buyer is warned that the Site Administration is not responsible for his visit and use of external resources, links to which may be contained on the site.

8.6. The Buyer agrees that the Site Administration is not responsible and has no direct or indirect obligations to the User in connection with any possible or occurred losses or damages associated with any content of the Site, copyright registration and information about such registration, goods or services, available on or received through external sites or resources or other contacts the Buyer entered into using information posted on the Site or links to external resources.

8.7. The Buyer accepts the provision that all materials and services of the Site or any part thereof may be accompanied by advertising. The Buyer agrees that the Site Administration does not have any responsibility and does not have any obligations in connection with such advertising.

9. Other conditions

9.1. All possible disputes arising from or related to this Policy must be resolved in accordance with the current legislation of the Russian Federation.

9.2. Nothing in the Policy can be understood as the establishment between the Buyer and the Operator of agency relations, partnership relations, joint activity relations, personal employment relations, or any other relations not expressly provided for in the Policy.

9.3. The court's recognition of any provision of the Policy as invalid or unenforceable does not entail the invalidity of other provisions of the Policy.

9.4. Inaction on the part of the Operator in the event of a violation by any of the Buyers of the provisions of this Policy does not deprive the Operator of the right to later take appropriate actions to protect its interests and protect copyrights on materials of the Site protected in accordance with the law.

The Buyer confirms that he has read all the clauses of this Policy and unconditionally accepts them.
